| HEALTH GUARANTEE |
The cat or kitten is guaranteed to be of sound health upon
arrival. It is guaranteed for a period of 72 hours from the purchase or arrival if vet checked within that
time. It is recommended that the new cat / kitten be in
quarantine during this time. If it is found to be medically deficient with an untreatable or life-threatening
problem It must be reported to the seller immediately.Breeder guarantees this Bengal against Defects and hereditary life threatening illness for 1 year from the date of delivery. Should this Bengal die or be diagnosed with any above referred conditions, the Breeder will replace this Bengal with a Bengal of comparable quality and value when available. This time of replacement should not exceed 8 months, except under undue hardship or Acts of God, in which case the Buyer agrees to additional time to fulfill this provision. NO CASH REFUNDS. The Breeder has the right as ask for this Bengal to be returned before Buyer receives a replacement. If the Buyer refuses replacement the Breeder will have no further obligation to the Buyer. The total liability to the Breeder will not exceed the purchase price of this Bengal. Buyer shall be liable to Breeder for any and all legal fees incurred.
It is the responsibility of the Buyer to provide immediate veterinary care to this Bengal if it shows signs of illness, distress or injury. Failure to provide veterinary care will render the Breeder’s contract guarantees null and void. Trauma, abuse or neglect of this Bengal will also void the Breeders guarantees.
If this Bengal has been exposed to another cat, that resident cat(s) must have a current negative test, i.e. within one year of the return date, for FELV/FIV and must not be an outdoors cat(s). The resident cat(s) must be free of parasites, fleas, ear mites, and communicable diseases in order for this Bengal to be returned. We require a statement as to the health of the other cats in the household by the Buyer’s Veterinarian prior to returning this Bengal.
Upon its return, it will be replaced with another
cat / kitten of equal value or the purchase price will be refunded. If no replacement is available at that time,
seller will have 8 months to furnish satisfactory replacement.
It is Under no circumstances is the kitten to be destroyed prior to notification by the buyer to the seller.
If the cat / kitten dies within the guarantee period, despite medical treatment, compensation will be made
ONLY if a veterinarian certifies the cause of death.
This cat / kitten is guaranteed against congenital defects for one year.Should it die within that time
as a direct result of a congenital defect, the cat will be replaced only if an appropriate autopsy
is performed by a licensed vet and a vet's certificate is provided as proof of cause of death. A replacement
will be made with a cat / kitten of comparable quality and value, as available, at the discretion of the
breeder. Due to the many factors involved in rearing and caring for this kitten that are beyond the control
of the seller, there are no guarantees on fertility or temperament.
This contract is legally binding to all parties involved. It applies only to the buyer and seller
in this transaction and nontransferableable to other parties. The buyer agrees to the terms and conditions, and
to pay as stated. Any balance carried over 30 days is subject to a 1.5% service fee 18% APR. In event of
default, the buyer will be legally liable for any reasonable attorney and or collection fee and all
related costs necessary to remit the entire balance to the seller. |
